3. Primary purposes of personal data processing.

VAHG informs you that the personal data provided by the Owner by any means, whether in writing or electronically, will be used primarily to (i) respond to requests for information, advice, legal services, or consultations; (ii) provide information about our legal services; (iii) provide services that may be or have been contracted; (iv) Contact the Owner by any means provided to VAHG to follow up on services; (v) Establish and maintain professional and commercial relationships.
The Owner consents to the use of their personal data for the primary purposes by accepting this privacy notice.

3.1 Secondary purposes in the processing of your personal data.

VAHG informs you that the personal data provided by the Owner by any means, whether in writing or electronically, may be used secondarily for marketing, advertising, or commercial prospecting purposes, including those communicated by email provided by the Owner, as well as for improvements in customer service and treatment. These purposes will require the express consent of the Data Subject in all cases.

The Owner must give their consent and exercise their ARCO rights (Access, Rectification, Cancellation, and Opposition) (detailed in point 6 of this Privacy Notice) individually for the primary and secondary purposes in the processing of their personal data in terms of Article 30 of the Law’s Regulations, and may revoke such consent at any time. Refusal to allow the use of your personal data for these secondary purposes will not be grounds for denying service.

If you do not want your data to be processed for secondary purposes, you may express this in accordance with the procedure outlined in this Notice.

The personal data provided to VAHG will be duly protected through technological, physical, and administrative security measures, preventing their misuse or disclosure. VAHG will use the personal data in accordance with the manner in which they are provided and collected, always in accordance with this Privacy Notice or its updates, which will be made available to you through the website.

4. Duration of the processing of your personal data

VAHG may process the personal data of the Owner while providing the services for which it was contracted and no right of Cancellation or Opposition is exercised in accordance with the ARCO rights detailed in this Privacy Notice.

Once the purpose for which the data was collected has been fulfilled, VAHG will block the use of the data and keep it for the sole purpose of determining possible liabilities in relation to its processing, until the legal or contractual limitation period for such liabilities has expired. During this period, the personal data will not be processed, and once this period has elapsed, it will be deleted from the corresponding database.

5. Transfer of personal data

VAHG may transfer personal data to third parties, whether individuals or legal entities, domestic or foreign, without the consent of the Owner, for the sole purpose of fulfilling the primary purposes indicated in point 3 of this Privacy Notice. This transfer will be made in the following cases:

• When the transfer is made to controlling companies, subsidiaries, or affiliates under the common control of the controller, or to a parent company or any company in the same group as the Responsible that operates under the same internal processes and policies;
• When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the owner, by the controller and a third party.
• When the transfer is necessary for the recognition, exercise, or defense of a right in a judicial proceeding; and
• When the transfer is necessary for the maintenance or fulfillment of a legal relationship between the controller and the data subject.

Third parties and/or entities receiving personal data shall assume the obligations and responsibilities that VAHG has assumed with the data subject.
Before using the services, the Owner may accept or refuse to allow their personal data to be transferred under the terms described above, in accordance with applicable legislation. Likewise, if they accept, they may at any time limit the use or disclosure of their personal data in accordance with point 6 of this Privacy Notice, regardless of their acceptance of its general content.

6. ARCO Rights

The Owner may at any time revoke the consent given to VAHG for the processing of their personal data, limit the use or disclosure thereof, and exercise their rights to: (i) Request from VAHG and know at all times what data is held about them, what it is used for, and the conditions under which VAHG processes it (Access); (ii) Request the correction and/or updating of their personal information, if it is inaccurate or incomplete (Rectification); (iii) Request that the information be removed from VAHG’s records or databases, when it is considered that it is not being used in accordance with the principles, duties, and obligations provided for in the Law (Cancellation); (v) Object to the use of your personal data for specific purposes (Opposition) (hereinafter the “ARCO Rights”) provided for in the Law.

The email with the request must be sent to mgonzalez@vahg.mx and must have the subject line: “Request to exercise ARCO Rights,” including:

1. The name of the Owner and their address or any other means of receiving notifications, including their email address
2. Documents proving the identity of the Owner or, where applicable, the personality and identity of their representative
3. A clear and precise description of the personal data for which they wish to exercise any of the ARCO rights, except in the case of the right of access
4. A description of the ARCO right that is to be exercised, or what the Owner is requesting.
5. Any other element or document that facilitates the location of the personal data.
6. In the case of exercising the right to rectify data, the Owner must indicate the modifications to be made and provide the documentation supporting their request.

Within the period established by law and under the terms thereof, VAHG will communicate its response to your request. If necessary, VAHG may ask you to expand or clarify the information you have provided through the aforementioned form in order to be able to fully respond to your request. If the request is appropriate, the decision will take effect within 15 (fifteen) business days following the date on which the response is communicated

7. Use of cookies and similar technologies

The website may use cookies and similar technologies to improve the browsing experience. These technologies can be disabled through the user’s browser settings.

8. Security measures

VAHG has implemented the necessary administrative, technical, and physical security measures to protect personal data against damage, loss, alteration, destruction, or unauthorized use.

9. Consent

The data subject declares that they have read and understood this Privacy Notice and gives their consent to the processing of their personal data in accordance with the terms set forth herein.

10. Modifications to the Privacy Notice

The Privacy Notice may be modified at any time by VAHG to comply with legislative changes or internal policies.
